Indemnity Waiver Agreement for Research Compounds

1. Acknowledgment of Research Use Only

By purchasing research compounds from Elite Miami Peptides, I, the undersigned customer (“Customer”), acknowledge and agree that:

• All products are sold strictly for laboratory research purposes only and are not intended for human consumption, veterinary use, or any diagnostic or therapeutic application.
  
  
• These products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.
  
  
• It is my sole responsibility to handle, store, and use these materials in compliance with all applicable laws, regulations, and laboratory safety protocols, including secure storage, record keeping, and controlled access.
  
  
• I understand that failure to follow these requirements voids all Elite Miami Peptides’ obligations under this agreement.
  
  

2. Age Verification & Legal Compliance

I confirm that I am at least 21 years of age and legally permitted to purchase and possess research compounds in my jurisdiction.
I acknowledge that Elite Miami Peptides does not sell products to individuals under 21 years old and may request valid government-issued identification for verification.
I am solely responsible for complying with all local, state, and federal laws regarding the purchase, storage, and research use of these materials.

3. No Medical Claims & No Warranties

Elite Miami Peptides makes no medical claims, express or implied, regarding the safety, effectiveness, or intended use of its products.
All compounds are supplied “as is,” without warranties of merchantability or fitness for a particular purpose.
No guarantees are provided concerning research outcomes, data accuracy, or experimental results derived from product use.

4. Assumption of Risk & Release of Liability

By purchasing, possessing, or using products from Elite Miami Peptides, I acknowledge and accept all associated risks.

I agree that Elite Miami Peptides, its officers, employees, and affiliates shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from the use, misuse, improper storage, handling, or disposal of its products.

I hereby waive any and all legal claims against Elite Miami Peptides and its affiliates related to my purchase or use of research compounds.
I accept full responsibility for compliance with all applicable research and safety regulations.

5. Indemnification

I agree to indemnify and hold harmless Elite Miami Peptides, its officers, employees, and affiliates from any and all:

• Claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees), fines, penalties, and regulatory actions resulting from my purchase, storage, handling, or misuse of these compounds.
  
  
• Legal actions, injuries, property damage, or third-party claims arising from or related to these products.
  
  

6. Gated Access & Customer Verification

6.1 I understand that access to product listings and checkout is restricted by age and research-use-only verification to ensure compliance with FDA and federal laws.

6.2 I acknowledge that the checkout process may require KYC verification, including my name, email, and one-time password (OTP) authentication. This data will be handled in accordance with applicable privacy and data protection regulations.

6.3 I accept that Elite Miami Peptides reserves the right to suspend or terminate access if false information is provided or misuse is suspected.

7. Binding Agreement & Governing Law

This agreement is binding upon myself, my heirs, executors, administrators, successors, and assigns.

If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect to best reflect the intent of the parties.

This agreement shall be governed by and construed in accordance with the laws of the State of Florida.
All disputes arising hereunder shall be adjudicated exclusively in the state or federal courts located in Miami-Dade County, Florida, without regard to conflict of law principles.

By proceeding with my purchase, I confirm that I have read, understood, and voluntarily agree to this Indemnity Waiver Agreement.
I acknowledge that my electronic acceptance constitutes a valid and binding signature under applicable law, and that a printed copy of this agreement shall be admissible in judicial or administrative proceedings.
